1. Overview

NexaForge Digital Ltd provides custom software development and IT services. Because our work involves bespoke deliverables created specifically for each client, our refund policy reflects the nature of professional services engagements rather than off-the-shelf products.

2. Project Deposits

Most engagements require a deposit prior to commencement of work. Deposits are non-refundable once the project has been initiated, as they compensate for planning, discovery, and resource allocation activities carried out on your behalf.

3. Milestone Payments

Where a project is structured around milestones, payments for completed and accepted milestones are non-refundable. If you choose to cancel the project after a milestone has been delivered and accepted, no refund will be issued for that milestone.

4. Cancellation Before Work Begins

If you cancel a project in writing before any development or billable work has commenced, you may be entitled to a full or partial refund of your deposit, less any reasonable administration costs incurred. Requests must be submitted to billing@pacheary.club within 5 business days of payment.

5. Cancellation Mid-Project

If you cancel an active project mid-engagement, you will be invoiced for all work completed up to the point of cancellation, calculated at the agreed day rate or project rate. Any overpayment relative to work completed will be refunded within 14 business days.

6. Defective or Non-Conforming Deliverables

If a deliverable does not conform to the agreed specifications as documented in the Statement of Work, we will remedy the defect at no additional charge within a reasonable timeframe. If we are unable to remedy the defect after a reasonable number of attempts, you may be entitled to a partial refund or credit at our discretion.

To request a refund, contact our billing team at billing@pacheary.club with your project reference, the reason for your request, and supporting documentation. We will acknowledge your request within 2 business days and aim to resolve it within 10 business days.

9. Governing Law

This policy is governed by the laws of England and Wales. Nothing in this policy affects your statutory consumer rights under applicable United Kingdom law.
